Employment law

The Employment team advises French and foreign companies of all sizes with a strong technological dimension.

The employment team advises on labour law and criminal labour law as well as individual and collective litigation (individual and collective relations, occupational risks and work-related stress, strategic reorganisations and restructurings, and various pre-litigation and litigation matters).

Its strength lies in its ability to revisit and adapt these issues to the Web3 ecosystem.

The firms of the sector generally have the ambition to change the world of traditional work.

This is why d&a partners regularly assists its clients in the implementation of a full remote mode of operation (100% teleworking) or in the area of remuneration and profit-sharing systems in crypto-assets (both at the request of employers and employees).

The tailor-made support offered by the d&a partners Employment department is reflected in a very close relationship with its clients, which must balance their innovative expectations with the legal and regulatory obligations in employment matters.

Individual relations

d&a partners Employment department assists its clients throughout the life of their employees’ employment contracts, whether for assignments in France or abroad (recruitment offers and employment contracts, secondment, assignment, expatriation).

In recent years, d&a partners has also had to be creative in the area of remuneration systems, as it has had to deal with an increased demand from its clients to set up remuneration systems involving crypto-assets.

d&a partners Employment team also assists its clients in matters of disciplinary law and employee departures (redundancies, contractual terminations, termination of employment, judicial terminations), which requires a certain creativity and tailor-made support.

Collective relations

d&a partners assists its clients in their relations with existing staff representatives, not only in the context of their establishment, but also in their day-to-day relations.

Given the technological field in which its clients operate and the specific employee population of its clients, d&a partners has to deal with new situations requiring a certain adaptability and therefore the development of its own internal procedures (internal regulations, teleworking charter due in particular to the increased development among its clients of full remote working, protection of personal data, etc.).

The Employment practice also advises and assists its clients in collective bargaining (organisation of working hours, specific agreements, mandatory negotiations, collective severance and mobility agreements, collective performance agreements, etc.,) in the face of growing companies in terms of employee numbers.

Finally, d&a partners assists its clients in their relations with the Labour Administration, which can be complex given the specificity/technicality of the ecosystem.

Strategic reorganisations and restructurings

d&a partners is frequently involved in reorganisations and strategic restructurings.

The Employment team assists its clients, alongside the Corporate team, in the conduct of various operations (acquisitions, mergers, transfers of activities, site closures, etc.) in order to assist its clients with the resulting social consequences (transfer of personnel, collective and individual redundancies).

The Social department also carries out social audits (acquisition, merger, transfer and compliance audits).
